HB 132 has passed the House and will be heard in the Senate Agriculture, Livestock & Irrigation committee Thursday, Feb. 21, 2019 at 3 p.m. in Room 317 of the Capitol building. Please ask your state senators in Montana to vote against HB 132, and ask Governor Bullock to veto HB 132 if it reaches him.

Definitions matter. One state legislator in Montana would like to define wild buffalo out of existence.

Rep. Kenneth Holmlund is sponsoring HB 132 to change the definition of a wild buffalo under state law to one that:

  • “has never been reduced to captivity,”
  • “has never been owned by a person,” and
  • “has never been subject to the per capita fee under 15-24-921,” a fee enacted in 1915 to enforce livestock laws.

HB 132 provokes a lot of questions. Montanans deserve clear answers.

Under the current definition, how many wild buffalo are there in Montana?

Under HB 132’s definition, would there be any wild buffalo now, or in the future?

Under HB 132, what buffalo herd in Montana – if any – would be wild?

How does HB 132 apply to buffalo herds in Montana under U.S. authority like the National Bison Range or Yellowstone National Park?

What is the meaning of “has never been reduced to captivity”?

What is captivity? A barbed wire fence? An electric one? A steel cage?

Does HB 132 apply to individual buffalo or the entire herd they are a part of?

HB 132 tries to define wild buffalo out of existence: none would exist as wild under state law now or ever.

Isn’t that the definition of extinction?
